    Yeah Right,

    If I'm the PM, I would be ignoring them for years to come.. May be If I ignore 'em, I would say it. Not keep doing lip service for 2 years. Not be held hostage by CHC.


    Frankly he has a lot more serious problems to worry about than our issues. from the backlog, we are around 0.25 million and you have 300 million people in this country and 10% of them unemployed. So yeah, blame him all you want but any sane politician in his position would do the same.

    Let's consider this for example. Imagine you were in India and you had a few 100,000 decently skilled immigrants from some other country, who were waiting for their green card. Now you are the PM and you have to choose your focus between fighting terrorism, fighting inflation, high budget deficits with healthcare costs, high unemployment rate or giving green cards to these 100,000 people. I would think there would be a lot of pissed off countrymen in India who would scream at you when you are ignoring real issues and focussing instead on giving green cards to foreigners especially when you already have a sky high unemployment rate. Wouldn't be a great political strategy, would it? But maybe you would still do it, perhaps if you have a vested interest in getting it done.

    Still, next year you can bet that he'll do something on immigration since the states have started legislating on their own now and they can't afford this to continue.

    but most of the people that I know of, who have very young kids ( 1 - 5/6 year olds) ..buying a house was a right decision. (and common sense says the same thing).
    I know people who bought townhouses, not big houses (thus paying mortgage which is slightly more than the apartment rents). They are not slogging extra and they are having single income. I keep re-iterating that what I meant is when things are conducive and situation is right. I do not know which part of that you do not understand.
    I said there are exceptions ..which part of that you don't understand !!

    It is not illegal to work on percentage basis. But if employer-employee relationship is now followed the way it should be followed by law then there are issues. For example, you are not in the same medical plans as employees or your work insurance is not covered (or you are not invited in annual christmas party for employees - just kidding). Specially, labor approval procedure has heavy dependency on prevailing wages and salary offered. In percentage basis there is no salary offered. Think about it.

    There is a gray area here. You can believe it is legal because it is nowhere mentioned that it is illegal. The certifying officer may believe that it is illegal because it is nowhere mentioned that it is legal.

    From what I understand, employers ready to pay all these benefits if employee decides to be salaried, but will not give employee control over the billing.

    In my case, I never take per diem, but I do find projects on my own and control over how much I must get and employer adjusts payroll accordingly because I marketed myself and also work hard at the client and get projects extended due to performance which benefits the employer, I also help employer with inhouse work. My wife has excellent benefits covered so I don't bother to take any benefits from my employer other than the money.

    Anyone can be paid a fixed consulting fee, just not h1b. You can find US citizens working for hourly pay because they don't need benefits as they may get through spouse.

    As long as you declare income and pay taxes, this is not a grey area.

    Once again, anti immigrants can make this also an issue as for them everything with H1b seems to be an issue.

    If you find enough people and have solid plan in place, I am willing to pay anywhere between $500 to $1000 towards the lawyer's fees....
    I am EB3-I and I have no intentions to port to EB2. But if you are planning to try to stop people who are willing to go through the hoops to get it done, all the best for you. In my opinion there is no legal ground for what you are trying.

    This is protectionism at it's best. Think about it.

    Why do you write 'I know this mess is depressing for EB3 folks' ?
    Is IV not with Eb3 folks? Or are they not important.

    Let me clear somethings.
    Earning in higher 70Ks in the year 2003 and with over 5+ years of progressive experience, they still went ahead a filed my app under EB3. Was that a mistake? Not mine. My employer knew that Eb3 would be slower.

    What happened? cases like mine were eye openers and learning experiences for comrades who were going to file and they filed under EB2, I asked friends and relatives and classmates of mine to file under Eb2.
    Am i happy for them? No, I hate them. Of course, I am happy for them. Very very much.

    So, why would you not fight for us?

    If people like me and filers before me had not filed under EB3, and not shared our experiences, how would we have progressed?

    Suddenly, 'You Eb3 folks are depressed' from 'We folks are depressed'. lol for chauvinism.



    I commend the initiative. But I see a few issues with it:

    You are complaining to DOS about USCIS and DOL. That will not work. Every agency has a specific role

    You are complaining to the official who sets visa dates. He has no authority to give relief just because some applicant/s are asking for it. He has to follow the rule every month and his responsibility is only to set the dates based on the statistics received from USCIS. This official has a very specific and limited role.

    The reasons are not compelling enough. You cannot just say you are waiting long enough and thus your date should become current. Rules cannot be changed just for that reason.

    If economy was down in 2001- 2003 and you were asked to file in EB3 and people in Perm could file in EB2 is your strongest reason, it may not work in your favor. Because by law you can file again and convert to EB2 and port your date. DOL and USCIS does not stop you from doing that.

    If you are qualified for EB2 but your attorney and employer filed in EB3, then it is not a fault of USCIS/DOL/DOS. You must talk to the company and the lawyer for it. If the company or the lawyer has broken any rule or employer has exploited you, then the letter should be complain to the appropriate authority about them.

    Please also note that labor is filed based on the degree and experience requirement of the job. By law if the requirement is only undergraduate degree for the job, the employer cannot file in EB2 just because the applicant has a masters degree or more experience than needed. So you cannot really put this arguement here because it will be against the rules.

    So I personally do not think this idea will work.

    While this mess is depressing for EB3 folks, we need to have a more compelling argument, determined membership and effective plan to get things changed.
    The root cause of the problem is limited greencard quota for EB3. And the solution is to get recapture, get rid of country limits, STEM exemption. Any single relief itself will be huge for all of us. With 179 phone calls and $16656 collected in last 3 months, I do not see that happening. It will need a far more bigger and determined effort. Such amount can be spent on full scale lobbying in just one month. 179 phone calls are nothing if we have to make a compelling case for ourselves.

    It is my reading that if India performs surgical strikes on the terrorist camps in Pakistan, Pakistan will not be able to do anything because according to Pakistan, there are no terrorist camps, so how can someone bomb a camp if that camp doesn't exist.

    I think US has told Gilani and Zardari not to respond if India conducts 1-2 surgical strikes. But Kaayani wants to respond. That's why Musharraf is making public statements saying that - if India strikes, "Democratically elected" President & PM will take steps to respond. Musharraf is putting the onus to respond on Zardari and Gilani. They do not want to respond. But Kaayani will order a response anyways, without a go ahead from Zardari and Gilani. There is only 1 stading institution in Pakistan - its army. We have to dismatle Pakistani army and ISI, otherwise it will continue to breed & foster more terrorist.

    EB1 requires either a tenure track position in research. I am a physician and did not want to be in a tenure track research position.
    Also EB1 without employment is very difficult to get. I would not have qualified for that.

    Yes, pete, other people should have hurdles. So when they stumble on those hurdles, it would be your gain.

    Its a zero sum game.

    We cannot all unite and work on this issue. So let's divide ourselves. Let's split IV into 2 organization, one for EB3 dumbasses who are getting a free ride and didnt go thru the whole 9 yards , and other for smart kids like you and rimzhim.

    Let me ask both of you. If you are that smart, how come you are not applying for EB1. I thought researchers would qualify for EB1. Why are you facing difficulty? Could it be that you are not really that good? Because the system does have an HOV lane for scientists to cruise to greencard. Its called EB1. And its current for most categories. What about that?

    Why dont you join the fast lane of EB1 and leave the bachelor's degree losers behind who didnt thru the whole 9 yards?

    Nowadays LCA becomes just a documentation and it does not prevent displacement or any abuse. It may be true that DOL may not have authority and resource to prevent abuse.

    Why someone whose permanent labor certificate is approved should have to go thru the process of adertising when his or her H1 is up for renewal? Can you please explain me what is the intent of permanent labor certificate as opposed to LCA in H1?

    Living in the US for approx. 8 yrs, I am mentally getting ready to move back to India. Just waiting to clear my debt and then move back. I came pretty close to buying a house in summer based on EB2 dates moving in Aug. and Sept. 08 but I am glad I didn't. Luckily, I am single and can take my own decision. If I had the opportunity to vote, I would vote John McCain.

    I think I agree with quite a lot of what you say. But I think there is some truth in Pakistani fears that India is already supporting anti-state actors in Pakistan, like in Balochistan.


    India is not yet spending its resources, and we all want India to spend substantial budget, say over $50 billion an year, to destabilize & disintegrate Pakistan.


    I don't think we all want that.
    I don't think even all Indians want that.
    I don't think its in the interest of India, or anyone else for that matter, to have a huge Afghanistan on its Eastern border.

    Good points, but let me put a counter argument. Two people , one is named SunnySurya and the other is named Mr XYZ. Both came to the USA at the same time in 1999. The difference was SunnySurya came here for his masters and the other guy came here through shady means.

    Mr XYZ was able to file his green card in 2002 in EB3 category based on his shady arrangements with his employer, whereas Mr SunnySurya continued to do right and socially acceptable things i.e. studied, got a job and then after several years this big company filled his green card in EB2 category in 2006.

    On the other hand after strugling for several years Mr. XYZ has collected enough years on his resume to be elligible for EB2. Now he want to port his PD

    SunnySurya's PD is 2006 and Mr. XYZ PD is 2002. Now if Mr. XYZ want to stand in EB2 line, I wonder what problems SunnySurya can have???:confused:

    Agree. Like labor subsitution scandal/abuse, you should have a documenterly evidence to go after this scam (creating duplicate EB2 job just to cut-short the line). If it is a USCIS rule, they may ripoff this ( like labor sub.). It is long way to go. The nut shell-- as long us GC is in high demand, people abuse the system. DOL, USCIS, knows this. Thatswhy DOL is auditing most EB2 labor certification. In my view, who ever filed EB2 between 2000 to 2004 (when EB3 was current) are true-EB2. After 2005, most of the EB2 filings are cut-short the EB3 que. Most of the cases not based on actual MINIMUM requirements for the job. Everyone knows this..

    Niira Radia should be given the Padma Shrimati next year. As each new tranche of the leaked tapes of Radiagate are made public it becomes increasingly clear that, far from sabotaging India's democracy, the lobbyist was actually furthering its cause.

    Though Radia's method of operation - which reportedly involves large-scale hawala transactions - was often dubious, there is nothing wrong with her broad strategy to influence public policy by inducing media people and other opinion makers to get A Raja the telecom portfolio. That his appointment - at least partly engineered by Radia - led to the 2G scam is another matter.

    Lobbying - or what is often called public advocacy - is a perfectly legitimate, and indeed necessary, component of any democracy. In the US, for example, it is considered to be a high-profile and respectable profession made use of by everyone who would like to have a say in the framing of official policy. New Delhi has often employed US lobbyists to try and influence Washington's policies vis-a-vis Pakistan and Kashmir, among other things. In the US, there are accredited lobbyists for all manner of issues and individuals, from the right to bear arms to candidates for Senate seats.

    If looked at in its broadest sense, what does lobbying boil down to? Nothing more, or less, than trying to get people to see your, or your client's view. All public relations exercises - be they for business interests or causes like animal welfare or AIDS prevention - are examples of lobbying: they are attempts to get the members of the public to change their ways of thought and action in particular spheres of interest or concern.

    Similarly, all forms of advertising - and no media product, including this newspaper, could remain economically viable were it not for advertisements - are lobbying by another name. Advertisements try to persuade you to buy a particular product or service. A successful ad, a lobbying exercise that has worked, is one that makes the maximum amount of money for the advertiser, the client of the lobbyist, in this case the advertising agency. The most successful ads - the ones that have been most persuasive in changing public behaviour and thinking - are annually honoured by receiving awards given by the industry.

    All politics, and not just at election time, is nothing but lobbying in its most blatant form. In a democracy, it is expected of all political parties to shape or transform public policy through competitive lobbying of the electorate via election manifestos and professed agendas. The voter is seduced, persuaded, bribed by all sorts of promised inducements, often in the form of cash subsidies or tax breaks, to support this or that party or candidate. There is the Election Commission to see there is no hanky-panky or rigging at the time of polling. But no Election Commission can compel a political party or candidate to make good on election promises - i.e., bribes in one form or another - once the balloting is over.

    If politics is unadulterated lobbying, and it is, so is the media. All reporters and commentators - in the press, or on TV or radio, even those considered too insignificant to have been approached by Radia - try to shape public opinion, and through that try to influence official policy by having public pressure put on it, according to their own views, opinions and interests, or those of the organisations that employ them.

    Indeed, democracy with all its components - media, market and elective politics - is a vast enterprise in lobbying, a never-ending argument between competing interest groups to change public policy to suit their own ends.

    Radia's only fault was getting caught. But for having forced us, however unwittingly, to take a long hard look at our democracy and what it really means, she needs a commendation. Padma Shrimati? Heck, make her Woman of the Year. She deserves it. Or rather, we deserve her.
